1) Terms of Use (ToU) – UCollectnow

1. Who we are
The UCollectnow.com website (the “Site”) is operated by the Publisher (“we”, “UCollectnow”). Our full identity and contact details are listed on the Site’s Legal Notices page. The Service includes: account creation, listing publication, user to user buying/selling, auctions, wallet/“credits”, promotion options (Top/Highlight), and advertising (banners).
2. Acceptance of the ToU
By accessing the Site or using the Service, you unconditionally accept these ToU and our other policies (Privacy, Cookies, Prohibited Items & Content). If you do not agree, do not use the Service.
3. Capacity – Account – Security
• Commercial use, payments and auctions are reserved for adults (age of majority in your jurisdiction).
• One account per person. You warrant the accuracy of the information provided and keep it up to date.
• You are responsible for keeping your credentials confidential and for all activity on your account. Notify us immediately of any unauthorized access.
4. Identity verification (KYC)
For security, anti fraud and compliance, we may require identity verification (third party provider) and suspend certain features (withdrawals, auctions, ads) until completion. We may refuse, suspend, or close an account if anomalies are detected.
5. UCollectnow’s role – User relationships
UCollectnow is a hosting and matchmaking intermediary. Unless otherwise stated, sales contracts are concluded between Buyer and Seller. UCollectnow is not a party to sales, does not guarantee item quality or conformity, and assumes no delivery or return obligation. We may, at our discretion, offer non binding mediation.
6. Listings, content and conduct
• You are solely responsible for the content you publish (texts, photos, prices, descriptions, condition, availability).
• You represent that you hold all necessary rights and you grant UCollectnow a worldwide, non exclusive, royalty free license to host, reproduce, display, adapt and promote such content as part of the Service.
• Prohibited (non exhaustive): illegal/stolen goods, counterfeits, weapons, drugs, hazardous products, regulated medicines/devices, live animals, personal data, unauthorized financial services, hateful/pornographic/violent content, malware, fraud, auction/click manipulation, spam, abusive multi accounting.
• We may remove content and suspend accounts in case of violations or legal risk.
7. Auctions and “Buy Now”
• Bids are binding: each bid obligates you to buy if you win. The Buy Now option ends the auction.
• Increments, duration, auto extension and payment rules are those displayed on the auction page.
• The Winner must pay within the stated deadline; otherwise the Seller may cancel and/or report the default. Limits, suspensions and fees may apply in case of repeated non payment.
• UCollectnow may cancel an auction in case of obvious error, fraud, prohibited item or legal order.
• Anti sniping: if enabled, any bid placed in the last minute extends the auction by 1 minute (a limit on extensions may apply; see the auction page).
8. Wallet and Credits
• The wallet is an internal payment account; not a bank account (no interest, not CDIC/FDIC insured or equivalent).
• Funding: via supported methods. Funds may be held for anti fraud checks for a reasonable time.
• Use: pay for listings, options (Top/Highlight), auctions, banners and other in app services.
• Withdrawals: subject to KYC, minimum $20.00, 1 withdrawal/day/user, anti fraud checks and absence of dispute/chargeback. Processed within a reasonable operational timeframe (business days).
• Refunds: unless required by law, top ups and consumed credits are non refundable. If a chargeback occurs, we may debit your balance, create a negative balance and restrict the account; set off against future payments/credits may occur.
• You may only use the wallet for lawful transactions related to the Service.
• Available vs. Held: available balance can be used in app and withdrawn; held balance (KYC/anti fraud checks) is temporarily unavailable.
• Availability of funds:
o Card/rails top ups: available after ~15 minutes (anti fraud window).
o Admin credits: immediate.
o Sales proceeds: available after 14 days (observation period), unless early release where risk is low; may be extended in case of dispute/fraud.
9. Payments – Third party providers
Payments are processed by providers (e.g., Stripe). You agree to their terms. We share necessary data for processing and anti fraud. We may hold, cancel or reverse a transaction in case of suspected fraud, error, prohibited item or legal order.
10. Advertising services (banners, Top/Highlight)
• Campaigns (budget, duration, targeting, formats) are prepaid and consumed by impressions/views/clicks per the displayed metrics.
• No performance guarantee. We may refuse or remove non compliant ads.
• Creative specs and pricing appear on dedicated pages and may change.
11. Fees, taxes and price changes
Applicable fees (listing, options, auctions, ads, withdrawals, etc.) are those shown at purchase time and may be changed prospectively. Prices are exclusive of taxes unless stated; applicable taxes may be added depending on your jurisdiction. Fee changes are prospective and do not affect completed purchases; the current schedule published on the Site prevails.
12. Shipping, hand off and returns
Buyers and Sellers agree on terms (price, delivery, insurance, tracking, local hand off). Customs, import fees and tax obligations are borne by the Buyer. Unless a mandatory right of withdrawal applies, returns follow the Seller’s policy.
13. Reviews, ratings and reports
Reviews must be honest and factual. We may remove off topic, abusive or manipulated reviews. Abuse reports should be filed via the provided tools.
14. Intellectual property
The Site and its elements are protected. Any unauthorized reproduction or extraction is prohibited. You warrant your content does not infringe rights and indemnify UCollectnow for claims related to your content/sales.
15. Personal data and cookies
Data processing is described in our Privacy Policy and Cookies Policy. By using the Service, you accept them.
16. Suspension and termination
We may suspend or close an account, remove content, hold funds and deny access in case of ToU breaches, legal risk, fraud or upon authority request. You may close your account at any time; certain obligations survive (amounts due, disputes, compliance).
17. Warranty & Liability (protective version)
The Service is provided “as is” and without warranty of any kind, express or implied (merchantability, fitness for a particular purpose, uninterrupted availability), to the extent permitted by law. UCollectnow is not liable for: (i) user content; (ii) user to user sales (quality, delivery, returns); (iii) indirect or intangible losses (lost profits, data, goodwill, opportunity); (iv) interruptions, bugs, maintenance, attacks, force majeure.
Liability cap. If our liability is nevertheless established, the total compensation owed to a user is limited to the lesser of: (a) the fees actually paid by that user to UCollectnow in the 12 months preceding the claim for the Service giving rise to the claim; and (b) CAD $100. This limitation applies even if UCollectnow was advised of the possibility of such damages and per user, in aggregate for claims relating to the same Service/facts. Remedies may be in the form of a service credit or fee refund. Exceptions: mandatory consumer rights, fraud/intentional misconduct, gross negligence, bodily injury.
18. Governing law – Disputes
These ToU are governed by the laws of the Province of Québec and Canada. Courts in the Judicial District of Montréal (QC) have jurisdiction, subject to mandatory consumer protection rules. You consent to electronic communications (email, in app notices).
19. Changes to the ToU
We may modify these ToU. The binding version is the one published on the Site with the update date. Material changes will be reasonably notified where required.
20. Contact
Our contact details appear in Legal Notices. For takedown requests (content or prohibited item), use the dedicated reporting procedure.
21. Indemnification
You indemnify and hold harmless UCollectnow, its officers, employees and partners from any claim, damage or cost (including reasonable attorneys’ fees) arising from: (i) content you publish; (ii) a transaction conducted via the Service; (iii) your breach of the ToU or law; (iv) your infringement of third party rights.
22. User to user release
To the extent permitted by law, you release UCollectnow from claims arising from Buyer Seller disputes. Any mediation we offer is non binding.
23. Wallet – Protective measures
We may hold, block, set off and/or reverse funds (recent top ups, disputes, suspected fraud, legal obligations). In case of chargeback, we may debit your balance, create a negative balance and require repayment; failing which we may restrict the account. No interest is due; the wallet is not a bank account. Unclaimed credits are handled per applicable laws.
24. Ads & metrics
Metrics (impressions, views, clicks) may be rounded, sampled and filtered for invalid traffic (bots, accidental clicks, fraud). We may adjust counts where invalid activity is detected. No performance guarantee.
25. Sanctions/export compliance
You represent you are not subject to sanctions nor located in an embargoed country and you agree to comply with applicable export control laws.
26. Security & acceptable use
Prohibited: scraping, unauthorized bots, circumvention of technical measures, reverse engineering, overload, harvesting others’ personal data, attempts at unauthorized access.
27. Force majeure
No party is liable for delays/failures caused by events beyond reasonable control (disaster, war, major network outage, acts of authority, general strike, etc.).
28. Miscellaneous
Assignment. We may assign this contract in connection with a reorganization or business transfer.
Severability – No waiver. Invalidity of a clause does not affect others; failure to enforce is not a waiver.
Language. FR/EN versions are authoritative; in Québec consumer context, the French version prevails in case of discrepancy.

2) Marketplace Terms of Sale (ToS)

UCollectnow acts as an intermediary. Unless stated otherwise, sales are concluded between third party Sellers and Buyers. These Marketplace ToS apply by default unless a professional Seller posts their own terms compliant with law and more favorable to the consumer. The ToU continue to apply to platform use.
1) Scope and Parties
1.1. Sales via the Site are between the Seller (user) and the Buyer. UCollectnow (“we”) provides hosting, payment tools, matchmaking, auctions and ads, and is not a party to the sale contract.
1.2. Sellers must comply with applicable laws (consumer protection, taxation, customs, product safety). Professional Sellers must disclose their status and comply with specific obligations (mandatory disclosures, legal warranties, withdrawal right, invoicing, taxes).
2) Offers, listings and accuracy
2.1. The Seller is solely responsible for descriptions, prices, photos, condition, provenance, authenticity and availability.
2.2. Manifest errors (impossible prices/features) allow cancellation before shipment.
2.3. Prohibited/non compliant items may be removed (see Prohibited Items & Content).
3) Contract formation – Orders – Auctions
3.1. Buy Now: the sale is formed when the Buyer confirms the order and the payment is authorized.
3.2. Auctions: bids are binding. On closing, the sale is formed with the Winner (best valid offer). Payment must be made within 72 hours after auction end unless otherwise stated on the auction page.
3.3. The Seller may cancel in case of suspected fraud, prohibited item, manifest error or proven unavailability. The Buyer may cancel before shipment only with the Seller’s agreement (unless a mandatory withdrawal right applies).
4) Price, taxes and currency
4.1. Prices are in CAD unless stated otherwise.
4.2. Taxes (e.g., GST/QST) are added where the Seller is liable and must be displayed/collected per law.
4.3. Customs duties/fees (import/export) are paid by the Buyer unless agreed otherwise.
5) Payment – Security – Reserves
5.1. Payments are processed via platform providers and/or the UCollectnow wallet (see ToU).
5.2. For anti fraud, checks, holds or temporary blocks may apply.
5.3. Title passes upon full payment.
5.4. In case of chargeback, the order may be cancelled; any return/refund follows the payment provider’s and/or authorities’ decision. UCollectnow may set off via the wallet per the ToU.
6) Invoicing
6.1. The Seller provides proof of purchase. A professional Seller issues a compliant invoice (legal mentions, taxes).
6.2. Invoices/receipts may be delivered electronically.
7) Delivery, risk transfer and pickup
7.1. Delivery timelines are indicative unless expressly firm.
7.2. Risk transfers: (i) on handover to the carrier where shipment is agreed; (ii) on in person hand off for local pickup.
7.3. The Buyer provides a correct address and tracks the parcel. For “undeliverable return”, re shipping costs may be charged.
7.4. Customs: the Buyer is responsible for formalities/duties, unless otherwise agreed in writing.
8) Withdrawal and returns
8.1. Where mandatory rules grant a right of withdrawal (e.g., certain distance sales to consumers), such right applies per its conditions and statutory exceptions (customized goods, unsealed items, public auctions, etc.).
8.2. Otherwise, returns follow the Seller’s policy shown on the listing. If none: return within 14 days of receipt, item in the same condition, return shipping at Buyer’s cost, refund of the item price (excluding original shipping), except damage attributable to the Seller.
8.3. Auctions may be non returnable unless mandatory law says otherwise.
8.4. Refund is issued to the original payment method or wallet within a reasonable time after receipt/inspection.
9) Conformity, authenticity and warranties
9.1. The Seller warrants the item matches its description and does not infringe rights.
9.2. Statutory warranties (e.g., conformity, hidden defects) apply where required by law (notably for consumers vs professional Sellers). Non professional Sellers may limit certain warranties as permitted by law.
9.3. For collectibles, grading/condition statements must be made in good faith. Any claimed authentication must be truthful and traceable.
10) Claims, disputes and payment protection
10.1. The Buyer must report any issue within 72 hours after delivery (or expected date) via Site tools, attaching photos/evidence.
10.2. Parties will cooperate in good faith for amicable resolution. UCollectnow may offer non binding mediation (no obligation of result).
10.3. Abusive chargebacks may lead to account limitations.
10.4. If unresolved, the ToU (governing law and courts) apply.
11) Cancellation
11.1. Before shipment: the Buyer may request cancellation; the Seller may accept/refuse.
11.2. The Seller may cancel for manifest error, prohibited item, suspected fraud, unavailability or legal order.
11.3. Won auctions are generally not cancellable by the Buyer, unless the Seller agrees or mandatory law applies.
12) Limitations and liability
12.1. Neither UCollectnow nor the Seller is liable for delays due to force majeure.
12.2. For UCollectnow: see ToU – Warranty & Liability (cap “lesser of”).
12.3. For the Seller: unless mandatory rules provide otherwise, liability to the Buyer is limited to the amounts actually paid for the item.
13) Anti fraud, compliance and sanctions
13.1. UCollectnow and providers may apply anti fraud checks, block operations, and request evidence (KYC, proof of shipment/receipt).
13.2. Professional Sellers must meet pre contractual disclosure, invoicing and after sales obligations.
14) Personal data
14.1. Processing is described in the Privacy Policy and Cookies Policy.
14.2. Sellers collecting data outside the Site are responsible for their own obligations (notice, legal basis, security).
15) Governing law and venue
15.1. These ToS are governed by the laws of the Province of Québec and Canada, conflict rules excluded.
15.2. Courts in the Judicial District of Montréal (QC) have jurisdiction, subject to mandatory consumer protection rules.
16) Changes
16.1. We may change these ToS. The current version and date appear at the top. Changes apply prospectively.

3) Privacy Policy – UCollectnow (EN)

1) Scope and controller
The Site and related apps are operated by the Publisher (“we”, “UCollectnow”). Our identity and contact details are listed on the Legal Notices page. This policy explains how we process your personal data when you use our marketplace/matchmaking services, auctions, wallet, credits and advertising.
2) Data we collect
• Account & profile: username, email, phone (if provided), language, shipping addresses, preferences.
• Identity verification (KYC): ID info/documents, selfies, automated checks via a provider.
• Transactions & wallet: top ups, payments, withdrawals, balances, partially masked payment methods, anti fraud and compliance logs.
• Payments (via provider, e.g., Stripe): payment tokens, statuses, amounts, chargebacks. We do not store full card numbers.
• Content & activity: listings, photos, descriptions, prices, bids/wins, messages/reviews, reports.
• Technical data: server logs, device IDs, OS/browser, IP addresses, timestamps, events (clicks, views, ad impressions), cookies and similar tech.
• Support: communications with customer support and evidence provided (e.g., in disputes).
3) Purposes and legal bases (GDPR)
We process data to: perform the contract (account, listings, auctions, payments, wallet, ads); ensure security & anti fraud (legitimate interest/legal obligation); KYC/AML CFT (legal obligation/legitimate interest); manage customer relationship (notices, service emails); improve & analyze (legitimate interest; analytics cookies subject to consent where required); advertising & marketing (consent/legitimate interest for invalid traffic control); and legal compliance (accounting, authority requests, rights management).
4) Cookies & trackers
See the Cookies Policy below (categories, lifetimes, consent and withdrawal of consent).
5) Sharing and transfers
We share with processors (hosting, security/anti fraud, analytics, email, KYC, payments, ad tech), other users to a transaction, authorities, and in case of a reorganization. Extra territorial transfers where applicable: Standard Contractual Clauses or another recognized mechanism, with supplementary measures where needed.
6) Retention (examples)
• Account: active use then up to 3 years of inactivity.
• Security logs: 12 months.
• Wallet/payments: statutory accounting/tax periods (generally up to 7 years, jurisdiction dependent).
• KYC: ~5 years after relationship end.
• Analytics/ads cookies: per consent and lifetimes in the Cookies Policy.
• Public content (listings/reviews): while published, then limited archiving.
7) Your rights
Depending on your jurisdiction (GDPR, Canadian laws incl. Québec), you may access, rectify, erase, restrict or object, and obtain portability. You may withdraw consent at any time (notably for marketing cookies). You may lodge a complaint with the competent authority (e.g., CNIL, OPC Canada, Québec CAI). To exercise rights: use the contacts in Legal Notices.
8) Automated decisions and profiling
We use automated systems for fraud and invalid traffic detection (ads). This may temporarily limit features (holds, access) pending review. Significant decisions receive appropriate human review.
9) Security
Reasonable technical/organizational measures (in transit encryption, access controls, logging, backups). No system is perfectly secure; please report any incident using our contacts.
10) Children
The Service is not intended for minors (commercial use/payments). We do not knowingly collect data from minors. If you believe a minor provided data, contact us for deletion.
11) Privacy governance (Quebec Law 25 & GDPR)
• Privacy Officer: see Legal Notices.
• DSAR (access/deletion etc.): dedicated address in Legal Notices; target response: 30 days; identity verification required; logging of requests and responses.
• Incident register: all privacy incidents recorded and assessed; notification to authorities/individuals as soon as practicable if there is a risk of serious injury.
• PIAs: conducted for higher risk projects/partners (new vendors, extra territorial transfers, sensitive data).
12) Changes
We may update this Policy. The current version and date appear at the top. Material changes will be reasonably notified where required.

4) Cookies Policy – UCollectnow (EN)

1) What is a cookie?
A small file stored on your device. Similar technologies may be used (local storage, pixels, SDKs).
2) Categories
• Strictly necessary: security, authentication, carts, fraud prevention (always active).
• Preferences: language, display settings.
• Analytics: understanding Site usage (subject to consent where required).
• Advertising & performance: banner serving, capping, invalid traffic detection; personalization with consent.
• Social: integrations/sharing (consent where required).
3) Consent management (CMP)
On your first visit, a banner lets you Accept all, Reject, or Customize. You can withdraw consent at any time via the Cookie Settings link in the footer.
Recommended text: “This site uses first party and third party cookies to improve our services and measure audience. Click Accept all to consent, Reject to continue without non essential cookies, or Customize to choose.”
We aim to honor GPC (Global Privacy Control) signals where available.
4) Lifetimes
• Necessary: session to 12 months.
• Preferences: up to 12 months.
• Analytics: up to 25 months.
• Advertising: 3–13 months depending on partner.
5) Partners
We may use providers for payments (e.g., Stripe), analytics, advertising, security/anti fraud. Current details may be shown in the Cookie Settings interface.

5) Prohibited Items & Content Policy – UCollectnow (EN)

1) Purpose
This policy complements the ToU and applies to all content/products posted and to user conduct on the platform.
2) Prohibited items (non exhaustive)
Illegal/stolen goods; counterfeits; weapons/ammo/explosives; drugs/equipment; hazardous materials/banned pesticides; prescription medicines/regulated medical devices without authorization; tobacco/nicotine products (unless expressly authorized and compliant); alcohol (unless expressly compliant); live animals/protected species; personal data, official documents; payment instruments/financial instruments; fraudulent gift cards; illegal services (hacking, DRM circumvention, forged documents); recalled/banned items; sexual content involving minors; hate/violence.
3) Prohibited content and behaviors
Deceptive misinformation, impersonation, shill bidding, auction/click manipulation, spam, harassment, terrorism advocacy, posting others’ personal data without legal basis, mass scraping, unauthorized bots, circumvention of technical measures, reverse engineering, attempts at fraud/money laundering/fictitious transactions.
4) Enforcement
Content removal, suspension/termination of accounts, fund holds (as permitted by law), cancellation of auctions/transactions, reporting to authorities, exclusion of repeat offenders. Ad metrics adjustments in case of invalid traffic.
5) Reporting & takedown (IP)
Use the Site’s reporting tools. For IP infringements provide: (i) your identity and authority; (ii) description of the work and the infringing elements with precise URLs; (iii) your good faith and accuracy declaration; (iv) your contact details; (v) any decision/order. UCollectnow may temporarily disable content during review. Repeat infringement: suspension.
